Judge Posner Questions Whether Owner of Patent on Heart Healthy Cookies Would Be Entitled To Nontrivial Damages


Last year I reported that Brandeis University had joined its exclusive licensee GFA Brands in suing a number of cookie companies for infringing its patents directed towards methods of "Increasing the HDL Level in the HDL/LDL Ratio in Human Serum by Balancing Saturated and Polyunsaturated Dietary Fatty Acids." The case is being heard by Judge Richard Posner in the Northern District of Illinois. On March 16, Judge Posner issued an interesting order in the case, ordering the parties to brief the issue of whether plaintiffs, if successful, would be entitled to nontrivial damage awards. Here is the order:

“I am concerned whether the plaintiffs if successful in establishing liability will be entitled to nontrivial damages awards. Suppose the defendants infringed the asserted patents but that none of the defendants marketed its products as low in bad cholesterol (LDL) or high in HDL, or as having a high ratio of HDL to LDL; and suppose further that the defendants obtained no cost savings by infringing the patents rather than using some non?infringing recipe and that neither Brandeis nor its licensee GFA Brands lost any business as a result of the infringement. On those assumptions, would the plaintiffs have any claim for damages, whether compensatory or punitive, or restitution? I would like the parties to address this question in briefs filed simultaneously by close of business on April 2.”
In other words, if the cookie manufacturers are not profiting from the healthy cookie recipe by using it to market their cookies, and the recipe does not cut their costs, then how has the patent owner been harmed, and what does Brandeis want the court to do? Perhaps the answer is that customers do pay a premium for healthier cookies, even if the cookie manufacturer does not use that information in marketing its products. And in any event, Brandeis/BFA would presumably like to get an injunction against the cookie manufacturers, as leverage to demand royalty payments, or to keep them off the market, thus reducing competition in the market for healthy cookies. But if the defendant cookie manufacturers do not profit from the technology, perhaps they will simply change their recipe, perhaps rendering their cookies less healthy but no less profitable.

It Will Never Be This Easy



 Life with Baby Fix-It is easy. Even when I am stressed out, frazzled, and breaking into a sweat because Im trying to juggle one too many things at once I know that our life is easy. We go for walks. Baby Fix-It (momentary pause -- I think its officially time to upgrade him to "Little Fix-It") points which way to go. We wander and find adventure. We go to the park and he plays happily. He lets me know when hes had his fill by trying to climb in the stroller. Theres no schedule. We go with the flow. Shopping trips are a breeze. He happily sits in the cart or helps me get things off shelves. He is generally a cooperative and just plain awesome kid. Of course there are meltdowns. And of course there are times when things dont go his way. But overall? I know I am truly lucky.

When we started down the road of fertility treatments last fall I kept coming back to the same thought over and over: Life will never be this easy again.

It makes me want to pause. Bottle time. Find a way to be as present as possible. The thought that life will never be this easy gives me both an amazing sense of peace and a jolt of anxiety.

A big, crazy, busy household has always been my dream. Little Fix-It is meant to be a big brother. Bring on the chaos, right? I cant wait. But, wow, this is going to be nuts.

It could always be worse


Hi there.
Thanks for popping in.

Wednesday is the day when we stop and look at things from a different angle, right?
Well, I was having a battle with the bank again this morning
and getting my knickers in a twist again.
But then I remembered somebody who could help me.
A high ranking bank manager ? Nope.
An accountant ? Not at all.

There’s a lady I know who is in such a sorry state.
She is so desperately ill and her health is detoriating daily.
Does she craft for relief?
She can’t craft because her arms don’t work.
Neither do her legs.
In fact, she can’t feed herself
 or drink, apart from through a straw.
Just before Christmas she fell out of her wheelchair 
and smashed her head open. 
Now it transpires that she also broke her leg in the fall,
which has to be in a cast for at least 3 months.
That brings with it a whole host of other terrible problems, 
not least bed sores and pneumonia. 

And we moaners moaned about having to put away the Christmas decorations, and the pine needles in the carpet and all the food that got wasted, 
and back to work, and traffic...bla bla bla bla

The thing is, she is as bright as a button, sharp as a pin,
very very clever, and completely compos mentis.
She is also a beautiful woman. 
Was a high city flyer before she became ill.
She’s younger than me. She’s got teenage kids. 

So why am I telling you about this lady?
Well, she may not be able to use her legs or her feet anymore, 
but she certainly gives me a kick up the arse every single day 
since I met her. 
Whenever I get overwhelmed, I think of her, because I know for sure she wishes she could be busy.
Whenever something doesn’t go the way I want it to, I think of her, because I don’t imagine she can even recall a time 
when it went right. 
Whenever I have a twinge in my back or neck, 
I think of her and a voice in my head says 
be grateful - be very, very grateful. 

So I for one will not complain or stamp my feet 
when things aren’t as I would like them.
If I ever have a tattoo done, it will read 
Gratitude

It Might Be Worth Going Back to High School for the KFC Chicken Drumstick Corsage


KFC is a contentious topic in my house. My boyfriends mom gave up on frying chicken when she spent four hours making the perfect drumsticks for an event, only to be told by attendees that it was "almost as good as KFC". Now, my boyfriend resents the brand as a symbol of the end of homemade fried chicken in his childhood home.

Still, if any of yall are in high school, you have my blessing in supporting the chicken behemoth because they brilliantly decided to PUT THEIR CHICKEN ON CORSAGES.

Really. Actually. In real life.

Purchasers can spend $20 on a corsage kit from a Kentucky-based florist, which comes complete with $5 gift card for a drumstick of their choice. According to the site, choices include "Original Recipe, Extra Crispy or Kentucky Grilled Chicken. Whichever best matches her dress."

This is both deeply hilarious and brilliant marketing by KFC, as their measly 100 limited edition corsages have captured media attention and made me want delicious chicken.

The only downside? Its often suggested (note: very unsourced) that corsages were originally intended to ward off evil spirits. If I were an evil spirit, I would definitely follow around the lady with a wrist covered in greasy food.
